1. Privacy Policy This policy sets out how Agricultural Innovation Australia Limited ABN 644 777 293 (AIA) collects personal information. It also describes how AIA holds, uses and discloses personal information.
AIA values and respects the privacy of the individuals we deal with. AIA is bound by the Privacy Act 1988 (Cth) as amended, which sets out a number of principles concerning the privacy of individuals.
By visiting AIA's website or providing AIA with your personal information, you consent to your personal information being collected, stored, used and disclosed as set out in this policy, and as otherwise permitted under the Privacy Act.
By providing personal information to AIA about any other person, you agree that:
you have made that person aware of the matters of which they are entitled to be made aware under the Privacy Act or the Privacy Principles contemplated by the Privacy Act;
AIA may contact that person without notifying you; and
AIA may disclose to that person your identity, and the fact that you have disclosed personal information about that person to AIA.
1.1 What is personal information Personal information means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information is true or not, and whether the information is recorded in a material form or not. It includes all personal information regardless of its source and regardless of whether it is publicly available.
1.2 Types of personal information collected The personal information which AIA collects and holds will depend on the nature of your interaction with us but generally includes your name, contact details (such as your phone number, address and email address) and general information about your business operations. It may also include credit card details if you are purchasing a product, your frequent flyer details, travel insurance details, dietary requirements or information from your résumé if we require these details for an event or for responding to a job application. We will ordinarily identify at the time of collecting your personal information which elements we require to facilitate your interaction with AIA.
You may be able to deal with AIA without identifying yourself (ie anonymously or by using a pseudonym) in certain circumstances, such as when you make a general enquiry about AIA or its programs. However, if you choose to deal with us in this way or choose not to provide us with your personal information, we may not be able to provide you with our services or otherwise interact with you. 1.3 Method of collection of personal information AIA generally only collects personal information if you choose to provide it yourself, for example in person, over the telephone, by post or email, via AIA's website or by completing online or hard copy forms. However, there may be occasions when AIA collects your personal information from someone else, such as when we engage a third party to assist us with sponsorships, training programs, events, surveys, research or when we jointly conduct a program or event with other organisations or consultants.
AIA also automatically collects certain information when you visit AIA's website. Such information includes your browser type, server address, operating system type, your IP address, how and when you use the AIA website and previous websites visited. AIA uses this information on anonymous basis and does not use it to personally identify you unless required to do so by law.
We may collect your personal information from third parties, including from a publicly available source (where it is unreasonable or impracticable to obtain information directly from you), or your employer (if your employer is a member, supplier or business contact).
You do not have to provide your personal information to AIA but, if you do not provide the information requested, AIA may not be able to provide you with its products and services. 1.4 Online activity There are many aspects of our website which can be viewed without providing personal information. For example, each time you use our website, we collect information about the browsing session including but not limited to browser type, version and language, operating system, pages viewed while browsing the site, page access times and referring website address. This information is only used internally for the purpose of gauging visitor traffic and trends and helping keep continuity as you navigate to different pages within the site. AIA uses this information on an anonymous basis and does not use it to personally identify you.
However, for access to support features for eligible members, you are required to provide personal information. This may include, but is not limited to, a unique username and password, your name, contact details and records of your dealings with us. When logged in as an eligible member, in addition to the information with respect to your browsing described above, we may also collect information by which we can identify the pages of our website that you visit, what you download from the website and how often you visit the website. We may use this information to improve our website, products or services.
1.5 Direct marketing We may send you direct marketing communications and information about our services, opportunities, or events that we consider may be of interest to you if you have requested or consented to receive such communications. These communications may be sent in various forms, including mail, SMS and email, in accordance with applicable marketing laws, such as the Australian Spam Act 2003 (Cth). You consent to us sending you those direct marketing communications by any of those methods. If you indicate a preference for a method of communication, we will endeavour to use that method whenever practical to do so.
You may opt-out of receiving marketing communications from us at any time by following the instructions to “unsubscribe” set out in the relevant communication or contacting us using the details set out in the “Contact” section below.
1.6 Purposes for holding and using personal information AIA uses the personal information that it collects for the purposes for which it was provided to AIA, to carry out AIA’s business purposes (which are detailed generally on AIA’s website www.aginnovationaustralia.com.au), to fulfil its legal obligations, other related purposes or as permitted or required by law. Where AIA documents request personal information, AIA will state the general purposes for its use and to whom it may be disclosed, and the main consequences, if any, if the information is not provided.
AIA’s general purposes may include: (a) providing products and services that you have requested and responding to your enquiries;
(b) administering AIA's programs and dealing with stakeholders;
(c) keeping AIA's members, their levy payers and relevant members of the public informed of AIA’s business, the products and services that it provides and issues relating to the agriculture, fisheries and forestry industries;
(d) conducting specific projects in which you have chosen to participate;
(e) administering competitions;
(f) administering events;
(g) including your details in publicly available databases on the AIA website;
(h) sending marketing material that AIA considers will be useful (if you have consented to receiving this). If AIA is notified that a person does not wish to receive such information, it will not send it to that person. This does not apply to information that we are legally required to send; and
(i) complying with legal requirements.
1.7 Disclosure of personal information Generally, AIA will obtain consent before it discloses any personal information other than as specified in this policy. Such consent may be given expressly or it may be implied by conduct. Some of the information that you provide to us will be published in documents or databases that will be readily accessible to the public or made available to the public on request. This includes information contained in the register of members.
Depending on the product or service, your personal information may be disclosed to:
(a) AIA's members and other related entities and representatives for the purpose of AIA’s business only;
(b) external service providers (on a confidential basis and such service providers will be limited in their use of the information to the purpose of AIA’s business only). In particular, AIA’s database is maintained on a server operated by a third party, under contractual obligations of confidence;
(c) specialist advisers to AIA who have been engaged to provide AIA with legal, administrative, financial, insurance, research, marketing or other services; and
(d) any other person authorised, implicitly or expressly, when the personal information is provided to or collected by AIA.
We contract with other companies such as data processors and service providers, some of which are located overseas. As such, your personal information may be provided to those third parties for purposes that include data storage and the use of cloud-based enterprise resource management.
Where we disclose your personal information to parties located overseas, we take reasonable steps to ensure that those parties will handle the personal information in accordance with the Australian Privacy Principles.
Those organisations and individuals will be given access only to the personal information necessary for the relevant purpose. AIA takes all reasonable steps to ensure that these organisations and individuals are bound by confidentiality and privacy obligations in relation to the protection of your personal information.
1.8 Security of personal information AIA takes reasonable steps to protect personal information it holds from misuse, loss and interference and from unauthorised access, modification or disclosure.
AIA will take reasonable steps to destroy or permanently de-identify personal information it holds if it is no longer needed for AIA's business purposes and it is permissible by law to do so.
1.9 Sensitive information AIA does not generally collect any sensitive information as that term is used in the privacy legislation (including information relating to racial or ethnic origin, membership of political bodies, religion or trade unions, sexual preferences or activities, criminal record, state of health or medical history). AIA will only collect sensitive information where required by law or with consent. If AIA holds any sensitive personal information, that information will only be used and disclosed by AIA for the purpose for which it was provided.
If AIA asks for sensitive information, AIA will explain the reason for this. 1.10 Access to personal information A person may request access to personal information that AIA holds about them by contacting AIA using the contact details below. AIA will process such requests within a reasonable time and may charge a fee for providing access to cover the costs of verifying the application and retrieving the information requested. If AIA denies an access request, it will provide reasons for doing so. 1.11 Correction of personal information AIA will take reasonable steps to ensure the personal information it holds is accurate, complete and up to date.
AIA should be promptly notified if there are any changes to an individual’s personal information by contacting AIA using the contact details below. A person may ask AIA at any time to correct personal information held by it about them. On request, AIA will take reasonable steps to correct the information so that it is accurate, complete and up to date, or will provide reasons for not doing so.
1.12 How to make a complaint If you wish to make a complaint about a breach of this policy or the Australian Privacy Principles set out in the Privacy Act 1988 (Cth), you can contact AIA using the contact details below. You will need to provide sufficient details regarding your complaint as well as any supporting evidence and information.
If you have raised a complaint, we usually respond in writing within 28 days, although we may need to ask you for more information to consider your complaint. If a complaint will take longer than 28 days to investigate, we will let you know the likely time for our response.
AIA will refer your complaint to its Privacy Officer who will investigate the issue and determine the steps that AIA will undertake to resolve your complaint. AIA will contact you if it requires any further information from you and will notify you in writing of the outcome of the investigation. If you are not satisfied with AIA's determination, you can contact AIA to discuss your concerns or contact the Australian Privacy Commissioner via www.oaic.gov.au. 1.13 Changes to this policy AIA may amend this policy from time to time, and the amended policy will be published on AIA’s website. Please review AIA's website periodically for changes to this policy. Your continued use of AIA's website or services or provision of further personal information to AIA once this policy has been amended constitutes your acceptance of the amended policy.
